LAWLIGHTS: THE MOTOR VEHICLE ACT.

Introduction:

                   Most of the people are known and came to know about the acts and rules of motor vehicle system in India, but at the same time this is considered to be very essential to spread the rules of motor vehicle ruling system to the people who are not aware of the terms completely.

Being a responsible citizen of a nation one should follow the rules implemented in the country and should raise the hand against the violation of the rights existing for the wellbeing of the people.

1.    The motor vehicle act, passed in the year 1988 by the Indian parliament.

2.    This act replaced the motor vehicle act 1939 and 1914, later the above act 1988 is replaced by the motor vehicles act, 2019.

3.    Comparable view of previous act and the new features of the motor vehicles (amendment) act, 2019.

And this amended act also provided seven highlighted provisions.

   1. SAFETY OF THE HUMANITARIAN

·       Safety for the people, who are in need of help at the time of a road accident.

2.    FUND SHOULD BE PROVIDED FOR MOTOR VEHICLE ACCIDENTS:

·       Compensation for people severely injured and died in a hit and run case will be increased from Rs.12, 500 to Rs.50,000 and Rs.25,000 to Rs.2 lakh.

3.    AADHAR CARD:

·       Producing aadhar card has been made mandatory identity proof for driving license.

4.    THIRD – PARTY INSURANCE:

·       This is hiked by the new provision from Rs.50,000 to

Rs.5 lakh.

5.    RECALL OF A VEHICLE:

·       The government can recall a vehicle where in a situation feels that there is a threat to driver.

·       In case of any failure, the manufacturer will be imposed with a fine of rs.100 crore with one year of imprisonment.

6.    ROAD SAFETY BOARD:

·       Separate organization is formed and assigned with the work of advising central and state governments on the road safety measures promoting new methodologies under jurisdiction.

7.    PREVENTION OF CORRUPTION:

·       To reduce corruption at the RTO new proposals of vehicle registrations are made.

·       Rs.1 lakh fine is imposed on road contractors in case of failure of the quality of road standards.

·       License and compliance to be issued for ola and uber cabs under ITC act, 2000.

    So many new provisions were added to the existing act and the fines are made higher to show the strictness and to mainatain the proper road rules and regulations of traffic, to avoid death rates due to road accidents.
