LAWLIGHTS- RIGHTS AND DUTIES OF A
CONSUMER UNDER THE COPRA ACT (PART 1)
INTRODUCTION:

In
and around the trend of consumers and their rights are consider as a very sensitive thing and the protection
of consumers from various damages certain laws were enacted to make consumers
feel safe from the exploitation of the manufacturers(sec 2(1) (j)}, traders, service
providers etc.

The
CONSUMER PROTECTION ACT 1986( ACT NO 68
OF 1986) was enacted with the main objective of protecting the consumer not
only protecting but also it include remedial measures aims at giving speedy
relief through simplified legal procedures, consists of four wide chapters with
total number of 31 sections.
·
The
CONSUMER PROTECTION ACT WAS AMENDED IN
2002 with more efficient rules to enhance the safety measures for
consumers.
·
Later
this act was REPLACED BY THE CONSUMER
PROTECTION ACT 2019.

RIGHTS OF A CONSUMER UNDER THIS ACT:
To promote
and protect the consumers in the ways such as,
RIGHT TO SAFETY
1. Right to be protected against marketing
of goods and service which are hazardous to life and property.
RIGHT TO BE INFORMED
2. Right to be informed about the
product quality, quantity, potency, purity, standard and price of goods and
service, as the case may be so as to protect the consumer from unfair or restrictive trade policies ( sec
2(1) (nn)}
RIGHT TO CHOOSE
3. Right to be assured wherever
possible, access to a variety of goods and service at competitive price.
RIGHT TO BE HEARD
4. Right to be heard and to be assured
that consumer’s interest will receive due consideration at appropriate fora
RIGHT TO REDRESSAL
5. Right to seek Redressal against
unfair trade practices, or restrictive trade practices or unscrupulous exploitation
of consumers.
RIGHT TO CONSUMER EDUCATION.
6. Consumers are given full rights for
their knowledge in products, goods and services.
SPEEDY AND SIMPLE LEGAL
PROCEDURES:
1.
DISTRICT FORUM:
This act
has made special provision for redressal agencies in a 3 level basis. In this
the low level hearing procedure for consumer’s grievances is at district level
known as district forum.
2.
STATE COMMISSION:
This is
next level of hearing agency at the state level called consumer disputes
redressal commission or state commission.
3.
NATIONAL COMMISSION:
This is
the highest level which hears for the consumer exploitation cases.

PROTECTION OF ECONOMICAL INTEREST

PROTECTION OF THE PUBLIC INTEREST
These are
the areas which are considered to be more important aspects that consumers are
needed to be protected because the rights inferred in the area of safety,
information, choosing the product and right to be heard.

This act attempts
to put an end to the black mark strategy inflicted upon consumers in many ways
like,

Black – marketing

Adulteration
3.
High prices
4.
False weights
5.
Measures
6.
Poor quality
7.
Selling of expired products
This act
is so REVOLUTIONARY LIKE ARTICLE 226 AND
32 OF OUR INDIAN CONSTITUTION on the judicial processes.
